Pending Ordinance Notice
Significant Water Consuming Land Uses
The City has formally initiated proceedings to amend the City’s land use regulations pertaining to significant water consuming land uses. Pursuant to Utah Code § 10-9a-509(1)(a)(ii)(B), the City is not processing or approving land use applications, including building permits, that would be prohibited by the proposed ordinance amendment.
The proposed ordinance prohibits land uses in the City that exceed an annual average of 300,000 gallons of water use per day and further clarifies the definition of “bottling plant” and prohibits bottling plants city-wide.
Pursuant to State Code, this action is effective as of July 8 and will remain in effect for a period of 180 days, expiring on January 4, 2022, or when final action is taken on the proposed ordinance, if earlier.
Any applications applied for during this time that the pending ordinance may prohibit will not be processed or approved while this notice is in effect. If at the expiration of this period the land use is allowed by City ordinance, the land use application can be approved subject to compliance with all other applicable regulations. Alternatively, if at the expiration of this period the land use is prohibited by City ordinance, the land use application will be denied.
