Traffic Citation Information

Plea in Abeyance

If you receive a traffic citation, you may be eligible for a plea in abeyance. This means your citation could be reported as a dismissal to the Driver License Division.

  • Plea in abeyance is not available if you were cited for speeding in a school zone.

  • If you were involved in an accident and want to attend traffic school, please contact a Judicial Assistant by phone or in person to see if you qualify.

  • If you have a Commercial Driver License (CDL), please contact the court directly.

You may qualify for a plea in abeyance if you meet all of these conditions:

  • Pay the violation fee plus a $25 plea in abeyance fee to the court first.
(The $65 traffic school fee will be paid online before you begin traffic school.)

  • The traffic violation does not require a mandatory court appearance.

  • The violation is not speeding more than 20 mph over the posted limit.

  • The City Prosecutor has approved the plea if the violation involves an accident and restitution has been addressed.

  • You are willing to plead guilty.

  • The plea in abeyance fee of $25 is assessed.

  • The fee assessed matches the Uniform Bail Schedule for the cited speed.

  • It is your first traffic offense within 12 months in this jurisdiction.

  • You agree to complete traffic school within 60 days.

  • You have fewer than 4 traffic offenses in the past 5 years in any jurisdiction.

  • You complete an online traffic school.

You must notify the court immediately if you change your address or phone number. Keep a copy of your plea in abeyance form for your records. After all conditions are met and verified, your plea in abeyance agreement will be docketed and submitted.

Online Traffic School

Before starting online traffic school, you must pay your citation and the plea in abeyance fee online. An authorization code will appear on your payment receipt. You will need this code to begin online traffic school.

Once you finish the traffic school and all conditions are verified by the court, your plea in abeyance agreement will be docketed and submitted.
