Midterm Vacancy

A City Council seat can be vacated for legal reasons, such as a Council Member’s relocation outside the district, death, or judicial removal. A City Council seat can also be vacated by resignation for personal and professional reasons.

Typically, a City Council Member provides a letter of resignation to the City Recorder and Council to announce the vacancy of their position. The Council then has 30 days from the resignation date to appoint a qualified resident to serve the remainder of the resigning Council Member’s term. If the remaining term exceeds two years, the appointed Council member will serve until the partial term ends, and the remaining two years will be filled through the municipal elections.

Interested individuals can apply to fill the vacancy by submitting an application and Conflict of Interest Disclosure Form in person to the City Recorder’s Office. A public notary will be available in the office.

Applications must be submitted within the window stated on the application form.
