The Rezone Request
The applicant is requesting to rezone property at approximately 265 E. 100 S. from MU-8 (Mixed-Use 8) to the D-1 (Central Business) zoning district. The D-1 zone allows taller buildings and more types of uses.
If approved, the property owner could redevelop the existing office building and surface parking lot into a mixed-use development with ground-floor retail and residential units, or other uses allowed under the zoning.
As part of a development agreement, the applicant is also proposing the following community benefits:
- Affordable Housing: 20% of the units would be affordable to households earning 80% or less of the area median income.
- Family-sized units would be included.
- Commercial space for local businesses with potential incentives to help lease the space.

The Planning Commission’s Recommendation
On Oct. 22, 2025, the Planning Commission recommended approving the proposal with the following conditions:
- The building height is limited to 225’.
- The property owner will work with commercial tenants to mitigate displacement.

Council Discussions
Feb. 3 Public Hearing
At the public hearing, residents shared support for more housing but raised concerns about the extra height allowed under the proposed D-1 zoning. They shared concerns about impacts on St. Mark’s Cathedral, including construction effects on the building and disrupting its services, and that taller buildings could block sunlight from the cathedral’s solar panels.
They also expressed that the increased building height does not fit with the surrounding neighborhood. Some shared that rezoning to MU-11 could be a suitable option. One resident added that the agreement should include clear, enforceable community benefits.
A representative from the developer group also came to the hearing and said they are listening and willing to work on ensuring this project works for all. The Council voted to continue the public hearing at a later date.
Jan. 20 Breifing
Planning staff presented the Council with an overview of a request to rezone property at approximately 265 E. 100 S. to allow a mixed-use development, with the developer present to discuss the proposal and address Council questions.
The Council raised several questions and concerns, including the rationale for requesting D-1 zoning rather than MU-11 and potential impacts on St. Mark’s Cathedral.
