Luke Martineau, on behalf of the property owners, is requesting approval from the Historic Landmark Commission to construct a new 119-unit multifamily building that will be partially located on the same lot as the B’nai Israel Temple. There are three lots associated with the project. The Temple is located at 249 S 400 E and the adjacent lots to the south at 251 and 253 S 400 E will be where most of the new building is constructed. The properties are in the R-MU (Residential Mixed Use) zoning district and the Temple is a Local Historic Landmark site which requires approval from the Historic Landmark Commission for any new construction on the associated site. The proposed new building will be located partially on the adjacent lots to the south of the Temple and wrap around behind it. The portion of the building located behind the Temple is the only portion of the building subject to HLC approval as it is located on the landmark site lot. The rest of the building is not subject to the new HLC construction process.
Three additional administrative processes (zoning incentives, planned development, design review) are requested for modifications that allow for a building that better achieves historic preservation and urban planning goals. These modifications can be requested and approved administratively as part of the building preservation zoning incentives application. The building preservation incentives will apply to the Temple and allow for administrative approval of the modifications below. The administrative applications do not require a public hearing and decisions on them will be made after the HLC decision.

- Notice of this application has been sent to the Chair of the Central City Community Council, where the property is located, who may choose to schedule the matter at an upcoming meeting. Please contact the chair of this organization to determine whether a community council will review this petition and when and how that meeting will occur. - Notice has also been sent to property owners and residents within 300 feet of the project to obtain public input and comments on the proposal. Notified parties are given a 45-day period to respond before a public hearing with the Planning Commission can be scheduled.
- During and following this comment period, the Planning Division will evaluate the proposal against the applicable standards, taking into consideration public comments as they relate to the standards, and develop a recommendation for the Planning Commission.
- The Planning Commission will then hold a public hearing for additional public comments and make the final decision on the matter.
