Child Daycare Center Amendments

Salt Lake City’s Planning Division is updating the Zoning Ordinance regarding Child Daycare Center and Home Daycare regulations in order to reduce regulatory barriers for these businesses in the city and better align local requirements with State Code.

What is the purpose of these proposed text amendments?

  • Align with state code regulations for child daycare centers and home daycares.
  • Clarify and simplify definitions to better align with state definitions.
  • Simplify or eliminate development standards for these uses when necessary.
  • Reduce the need for land use permits for these uses in all zones.
  • Reduce development standards without negatively affecting neighborhood communities.

Update 9/5/23: Staff has received new information from the State Licensing Division regarding Home Daycares. Specifically, that an existing Home daycare licensee may open up a second location for their business in a residential building without requiring a permanent residential use. After some research and a discussion with the Salt Lake City Planning Commission, staff has determined that the need for small, neighborhood daycares is an important and urgent demand of working parents. Therefore, we have updated the proposed amendments to allow this second Home Daycare location.

Next Steps

  • Notice of this application has been sent to Community Council Chairs throughout the City, who may choose to schedule the matter at an upcoming meeting. Please contact the chair(s) of these organizations to determine whether a community council will review this petition and when and how that meeting will occur.
  • A 45-day notice period to solicit comments on the chapter updates is held before a public hearing with the Planning Commission can be scheduled. This notice period will end on July 28, 2023.
  • During and following this comment period, the Planning Division will consider all public comments received and make appropriate modifications to the chapter updates to better meet the needs of the City. 
  • The Planning Commission will then hold a public hearing for additional public comments and make a recommendation to City Council.
  • City Council will hold a public hearing for additional public comments, the City Council will have the final decision on the matter.

What is the role of the Planning Staff in this process?

Planning Staff responds to public comments, answers questions regarding best management practices, will make appropriate modifications to the draft chapter, and will brief and make recommendations to Planning Commission and City Council.

  • Start of Public Comment Period: Tuesday, June 13, 2023
  • End of the Public Comment Period: Friday, July 28, 2023

During and following this comment period, the Planning Division will evaluate the proposal against the applicable zoning standards, taking into consideration public comments as they relate to the standards, and develop a recommendation for the Planning Commission.
